Media Regulation in Romania
The paper aims to succinctly present the legal background regulating the functioning of the audio-visual market in Romania, the system and logic behind home media regulation from the Constitution to the right of issuing orders of the National Audiovisual Council. It presents in detail the demographic context influenced by the Romanian media market, the consumer customs and needs this latter fulfils, the pertinent constitutional and legal requirements, and the functioning of the body in charge with media regulation. In addition, the paper presents the main aspects of content regulation, such as advertisement regulation based on EU directives, underage (minority) protection, the protection of human dignity, the sometimes exaggerated requirements pertaining to correct information, the must-carry principle in strong contradiction to market principles and actual power relations. The paper sums up for the interested outsider the most important facts and aspects in media regulation.
